TOWN OF QUARTZSITE
REGULAR MEETING OF THE COMMON COUNCIL 
TUESDAY, OCTOBER 12, 2010 7:00 PM

 

 

CALL TO ORDER:  Mayor Foster 7:01 P.M.

INVOCATION:  Mayor Foster.

PLEDGE OF ALLEGIANCE:  All in attendance.

ROLL CALL:  Mayor Foster, Vice Mayor Cowell, Council Members Anderson, Kelley, Lizarraga, Lukkasson and Winslow.

STAFF PRESENT:  Town Manager Alex Taft, Town Attorney Walsma, Town Clerk Karen Norris, Al Johnson C.B.O., Finance Director Heidi Turner, Utilities Clerk Cindy Harvard and Police Chief Jeff Gilbert. Also present: Triguna Israel, Principal Engineering. 

REPORTS & ANNOUNCEMENTS
Arizona Archives Month Proclamation – Mayor Foster.

Mayor Foster announces that Karen Norris has completed her training and is now a Certified Municipal Clerk.

Council Member Winslow announces two new businesses in town.  WIGO; a computer service and repair center and Discount Tobacco Outlet; retail tobacco sales.  Scholars’ Academy football team won the football game last Friday night and their next game is October 22, 2010 at 7:00 p.m.  Council Member Winslow also reads aloud a letter from Mr. Kenny King and Mal Mallory of the Quartzsite RV Show commending the Police Department for their work and arrest regarding a burglary that took place on their property.

Ms. Cyndi Ferrell of A.P.S., Community Development Department, states their goal is to keep the lines of communication open.  Ms. Ferrell states she has brought informational books on Pinnacle West, which gives more information on the company.  Ms. Ferrell introduces Mr. John Croteau, the new leader for La Paz County.  Mr. Croteau comments that he is replace D.L. Wilson.  His goal is to improve communications with the Town and the community.   Mr. Croteau states if there is anything the Town needs please just let him know. 

Ms. Jennifer Harris announces that her dog Butterscotch Sunday took first place at the Nationals Specialty last weekend.  Ms. Harris announces that she will be running for one of the seats on the Council.  Mr. Harris announces she will be grooming this year and will be opening soon; also that she is starting a new free community newspaper.  She anticipates having the first issue out the first of December.  Ms. Harris comments regarding a restraining order against her by Shanana Rain Goldenbear and Star Bearcat, and invites everyone to come to the hearing on October 21st at the Magistrate Court across the street at 3:00 p.m.

Ms. Shanana Rain Goldenbear, the Centennial Committee announces they had a wonderful meeting today.  Rain thanks Mountain Quail RV Park for the birthday cake and refreshments.  Rain announces their next meeting will be Monday, October 25th at 7:00 p.m. at the QIA.  Rain announces they have hats and bags for sale in the back.

Ms. Monica Timberlake gives a report on the Quartzsite Country Bash that took place in the Park last weekend.  Monica thanks everyone who helped make this First Annual Country Bash a success. 

Mr. Elmer London comments regarding Council procedures for address by the public. 

CONSENT AGENDA:
1.  Approval of accounts payable (Check Series: 30816 – 30886/total = $210,258.81)
2.  Approval of Minutes of Regular Meeting of September 28, 2010.
3.  Approval of Minutes of Special Meeting of October 5, 2010.
4.  Approval of lowest responsible bidder, Caymus Corporation – Quartzsite Gateway
     Signage and Landscaping Project.

Mayor Foster states there are a couple of corrections to the minutes of September 28, 2010.  Page 3 item number 3 the name is Ulmer not Almer; and changing the word “what” legislation to “that” legislation; page 4 item number 7 is changed to add addendum made by Council Member Kelley to include “approval of conditions of development” with the motion. 

Council Member Lukkasson motioned to approve the consent agenda items 1 – 4 as written.  Motion seconded by Council Member Kelley.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED. 

NEW BUSINESS:  
101210 – 1.  Discussion and possible award of Plymouth Road Beautification Project and Quail Trail Beautification Project.

Mr. Triguna Israel is present to answer any questions Council may have on this item.
Council Member Kelley motioned to possible award Plymouth Road Beautification Project and Quail Trail Beautification Project.  Motion seconded by Council Member Lukkasson.  Town Attorney Walsma asks Council Member Kelley to clarify if his motion is to award the project.  Council Member Kelley states “yes” it is to award the project.  Council Member Lukkasson states that “yes” that is what he has seconded.  Council Member Lizarraga questions whether or not they need to specify which bid they are going to accept. Council Member Kelley and Council Member Lukkasson withdraw the motion and second.  Council Member Winslow motioned to award the contract to Caymus for the Plymouth Road Beautification Project and Quail Trail Beautification Project item number 101210 – 1.  Motion seconded by Council Member Anderson.  Town Attorney Walsma points out that Caymus is not a bidder on this project.  Council Member Lizarraga motioned to award the bid to Nickle Contracting L.L.C. lowest bid, for $417, 500 for Plymouth Road and Quail Trail Beautification Project.  Motion seconded by Council Member Lukkasson.  Town Clerk Norris points out there is still a motion by Council Member Winslow and a second by Council Member Anderson on the floor.  Council Member Winslow and Council Member Anderson withdraw the motion and the second.   Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED

101210 – 2.  Discussion and possible approval of Resolution No. 10-20; Residential Antidisplacement and Relocation Assistance Plan for FY 2010.

Mayor Foster points out three areas in the Resolution where “Town of Quartzsite” needs to be inserted; “name of applicant” was not typed in.  Council Member Anderson motioned to approve Resolution No. 10-20; Residential Antidisplacement and Relocation Assistance Plan for FY 2010.  Motion seconded by Council Member Lukkasson.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED

101210 – 3.  Discussion and possible action to chose a water rate study firm.

Mayor Foster motioned to approve Economist.com to do the water rate study for the Town of Quartzsite.  Motion seconded by Council Member Lukkasson.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED.

101210 – 4.  Discussion and possible approval of Ordinance No. 10-16; Revising Town code Chapter 20 ~ Health and Development Services Board.

Council Member Lizarraga motioned to approve Ordinance No. 10-16; Revising Town Code Chapter 20 ~ Health and Development Services Board.  Motion seconded by Council Member Winslow.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED.

101210 – 5.  Discussion and possible approval to go into Executive Session pursuant to A.R.S. §38-431.03 (A) (3) for the purpose of consulting with the Town Attorney regarding Ordinance No. 10-12; Prohibition on use of fireworks in the Town Limits.

Council Member Lizarraga motioned to go into Executive Session.  Motion seconded by Council Member Winslow.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED.  Convened 7:40 PM

Roll call of the Council – All Council Members present.  Alex Taft, Town Manager; Pamela Walsma, Town Attorney and Karen Norris, Town Clerk present also.

101210 – 6.  Discussion and possible action to revise Ordinance No. 10-12; Prohibition on use of fireworks in the Town Limits.

Council Member Lizarraga motioned to direct staff to do research the prohibition on use of fireworks in the Town Limits.  Motion seconded by Council Member Winslow/Anderson.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED.

101210 – 7.  Discussion and possible approval to direct staff to research the zoning code regarding propane sales.

Council Member Lizarraga motioned to direct staff to research the zoning code regulations regarding propane sales.  Motion seconded by Council Member Kelley.  Mayor Foster calls for the vote.  Vote – 7 in favor.  MOTION CARRIED.

COMMUNICATIONS/PETITIONS & CITIZEN COMMENTS: (call to the public)
Mr. Bob Miller, resident states he has a comment regarding an issue that is bothering him.  Mr. Miller gives Council a hand out regarding his issue.  Mr. Miller comments regarding the protocol for release of public information.  Mr. Miller states Arizona laws regarding this are clear and concise.  Mr. Miller comments regarding a public records request he currently has in at Town Hall, it has not been addressed yet.  Mr. Miller asks if the Council and the Mayor would look into his complaint of public records requests protocol at Town Hall. 

Mr. Doug Gilford states he has had a similar experience regarding public records requests also.

Ms. Shanana Rain Goldenbear comments regarding October being National Bullying Month.  Ms. Goldenbear comments regarding the heightened awareness of this issue most recently. 

Mrs. Michelle Lukkasson, resident, thanks Miss Monica Timberlake for all her hard work and efforts on the First Annual Quartzsite Country Bash.  Mrs. Lukkasson states they still have T-shirts from the Bash at the Quartzsite Laundrymat at discount prices.
